TERMS AND CONDITIONS

Welcome to Leontine Linens (“we,” “us,” “our,” or “Leontine Linens”). These Terms & Conditions (“Terms”) govern your access to and use of our website (the “Site”). By visiting, browsing, or making a purchase on the Site, you agree to these Terms.  If you do not agree, you should not use the Site or our services.

Use of the Site

We grant you a personal, limited, non-exclusive, non-transferable license to access and make personal use of the Site and information contained on the Site. This license does not include, and we expressly prohibit, any resale or commercial use of the Site and any collection or commercial use of any photographs or other materials published on the Site.  You may use the Site only as permitted by law and these Terms. All rights not expressly granted to you in these Terms are reserved and retained by us.  The license granted to you automatically terminates if you do not comply with these Terms.

You further represent and warrant that you own or otherwise possess all rights necessary to grant the foregoing license and that your  User Content does not infringe or violate any intellectual property, privacy, publicity, or other proprietary or legal rights of any third party. We reserve the right, at our sole discretion and without notice, to refuse, remove, or decline to display any User Content for any reason whatsoever.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LEONTINE LINENS OR ITS OWNERS, EMPLOYEES OR AFFILIATES  BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING FOR THE INDIRECT LOSS OF PROFIT, REVENUE, OR DATA) ARISING OUT OF OR RELATING TO THE SITE HOWEVER CAUSED, AND UNDER WHATEVER CAUSE OF ACTION OR THEORY OF LIABILITY BROUGHT (INCLUDING UNDER ANY CONTRACT, NEGLIGENCE, OR OTHER TORT THEORY OF LIABILITY) EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR MAXIMUM LIABILITY FOR ANY CLAIM RELATED TO YOUR USE OF THE SITE SHALL BE $100.00.

Modifications to Terms

We may revise these Terms from time to time. When we do, we will post the updated version on the Site with a new “Effective Date.” Your continued use after that constitutes acceptance of the new Terms.

Termination

We may suspend or terminate your access to the Site (or portions thereof) at any time, without notice, for any reason (including violation of these Terms).

Governing Law & Dispute Resolution

These Terms are governed by the laws of the state of Louisiana, excluding conflict-of-law principles.  Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association in New Orleans, Louisiana, with each party bearing its own costs.  The Parties agree that any dispute, claim, or controversy arising out of or relating to this Agreement shall be resolved on an individual basis only. You expressly waive any right to participate in or bring any class action, collective action, or any other representative proceeding against us.  Notwithstanding this arbitration provision, we may seek injunctive relief in any court of competent jurisdiction.

Severability & Waiver

If a provision in these Terms is held invalid or unenforceable, the rest remain in effect.  Our failure to enforce any right under these Terms does not constitute a waiver of that right.

Entire Agreement

These Terms constitute the full agreement between you and us regarding the Site and supersede any prior agreements.
